This privacy policy describes the information Lundberg Family Farms® collects about you and how it is shared or otherwise used, your rights and choices with regard to that information, and steps we take to protect your information. This privacy policy applies to personal information collected by or on behalf of Lundberg Family Farms® (the “Farm”, “we”, “us), including information collected through our website at www.lundberg.com and mobile versions of our website (collectively, the “Site”), by email, phone or other offline contacts, and anywhere else we display this privacy policy (collectively, the “Services”). By using or interacting with the Services, you accept and consent to the terms of this privacy policy in effect at the time of your use.




INFORMATION WE COLLECT
Personal information is information that directly or indirectly identifies you or can be used to identify you as an individual. The following are the categories of personal information we may collect about you and how we collect it:

Information You Provide. We collect personal information that you provide when you visit or interact with the Services. For example, you may provide your name and e-mail address if you sign up to receive special offers and the latest news from the Farm. In addition, you may also provide optional demographic information to us so that we can provide you a more personalized experience on the Site. If you submit information through our contact, feedback or complaint form on the Site, you may provide your contact and demographic information (such as your name, e-mail address, phone number, postal address and age range) or any other comments, testimonials, or information you choose to provide in your message or upload with your request.



We or our service providers collect your name, shipping address, billing address and other payment information when you make a purchase through the Services. We will also request certain personal information, including your name, mailing address, email, and occasionally demographic information, if you choose to create an account, participate in contests, promotional events, or surveys we make available through the Services. We also collect your user information and password to authenticate your account.



We also collect and maintain personal information if you are a job applicant or candidate and apply for job openings with us. This personal information includes, but is not limited to job applicant or candidate first and last name, email address, telephone number, physical address, gender, ethnicity, disability and veteran status, educational history, professional references, job history and any other information you choose to provide as part of your resume or application for employment. We collect and maintain this information to determine eligibility for employment, including verification of references and qualifications; assessing qualifications for a particular job; complying with applicable laws, regulations, and statutes, or for such other purposes as are reasonably required by us as otherwise set forth in this privacy policy; or to communicate with you about your application for employment or potential job openings. We may share this information with our service providers as necessary for the purposes of determining your eligibility and qualifications.

The information you provide is completely voluntary and you can choose not to provide personal information to us. However, some information about you is generally required to respond to your requests, participate in a contest, promotional event or survey, or take advantage of certain services we provide.



Information Collected Automatically. We also automatically collect certain information when you access the Site using tracking tools that help us improve the Site and personalize your experience. This information typically remains in aggregate form and does not identify you individually but if it does, we will treat the information as personal information. We collect the following categories of information using automated tracking technologies:


  • Usage Data: We may collect information about how the Site is accessed and used ("Usage Data"). This Usage Data may include information such as your computer's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.
  • Cookie and Other Tracking Data: We use cookies and similar tracking technologies to track the activity on the Site and hold certain information. Cookies are files with small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device.   • Analytics Data: The Site also uses analytics tools such as Google Analytics, a web analytics service provided by Google, Inc. that uses cookies to help us analyze how users navigate the Site. The information generated by a cookie about your use of the Site (including your IP address) will be transmitted to and stored by Google in aggregate form. Google uses this aggregated information on our behalf in order to evaluate use of the Site, compile reports on Site activity and other services relating to Site activity and usage. HOW WE USE OR SHARE YOUR PERSONAL INFORMATION
We use the information we collect from you for our business and commercial purposes, including to provide you with products you purchase, information or services you request, to address any other reason you contacted us or otherwise communicate with you, conduct research of the Site’s visitors for use in our business and product planning and improvements, and to improve our overall service to you. We may also use your information for data analytics, to detect and prevent fraud and maintain the security of the Services, to comply with our legal obligations or to protect the health and safety of you or others.



We may use your personal information to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you. Lundberg Family Farms will not disclose or share your information outside of our corporate organization, except as set forth in this privacy policy, with your consent, or as required by law. We may share your information with:


  • Our family of companies, including parent company, subsidiaries and affiliates in accordance with applicable law.
  • Service providers engaged to provide services to support our operations and other business and commercial purposes. Our service providers are contractually required to protect your information and only use your information to provide services to us.
  • Business partners such as data aggregators, advertisers, media buying agencies, advertising networks, social networks.
  • A successor entity in the event of a corporate merger, consolidation, sale of assets or other corporate changes to Lundberg Family Farms and/or affiliated companies.
  • Other third parties as necessary to protect our legal interests or property, to comply with applicable laws and regulations or other legal requirements, or to protect your health and safety or the health and safety of others.

YOUR RIGHTS AND CHOICES
You may opt out of receiving communications from us at any time by contacting us using the methods listed in the Contact Us section at the bottom of this privacy policy or by using the unsubscribe links included in communications from us. Please note that even if you unsubscribe from our marketing communications, you may still receive emails, mailings or other communications related to your transactions with us.



Some content on the Services may be served by our third-party advertisers, ad networks and servers. These providers may use cookies or other tracking technologies that collect information about your online activities over time and across different sites, in order to provide you with interest-based advertising or other targeted content on our behalf. “DO-NOT-TRACK” SIGNALS
Some browsers have “do not track” features that allow you to tell a website not to track you. These features are not all uniform. While we continue to evaluate this evolving technology, the Site does not currently respond to browser-based “Do Not Track” signals. INTERNATIONAL USERS
Lundberg Family Farms and its affiliated companies are based in the United States. Our Service and the Site are not targeted at individuals outside the United States. If you are visiting the Site from outside the United States and provided us with personal information, please note that your information may be accessed or transferred, stored and processed by Lundberg Family Farms or its affiliated companies in the United States. The data protection or privacy laws in the United States may be different than those in your country. By doing business with or interacting with Lundberg Family Farms or the Site or Services, you acknowledge and agree to the transfer of your personal information to facilities located in the United States and understand that such information will be stored and processed in accordance with this privacy policy and the laws of the United States.

  • Right to Delete: You have the right to request us to delete the personal information we have collected or maintain about you.   • Right to Opt-Out of Sale/Share: You have the right to opt-out or ask us not to sell or share your personal information we have collected about you to third parties, including for ad targeting/cross contextual advertising. You do not need to create an account with us to exercise your Right to Opt-Out of Sale/Share. However, we may ask you to provide additional personal information so that we can properly identify you in our dataset to facilitate the opt-out request. If you choose not to provide this information, we may only be able to process your request to the extent we are able to identify you in our systems.

We do not discriminate against you for requesting any of the rights noted above.  We will process your request in accordance with applicable law. 



You can exercise these rights yourself or you can designate an authorized agent to make a request on your behalf. If you would like an authorized agent to submit a request on your behalf, we will also need sufficient information to verify that then you are the individual about whom we collected personal information and that the agent is authorized to submit the request on your behalf. We may verify the authorized agent’s authority to act on your behalf as follows:


For requests to know, access, correct or delete personal information, we may ask you to provide sufficient evidence to show that you have provided the authorized agent signed permission to act on your behalf, verified your own identity directly with us pursuant to the instructions set forth in this Notice, and directly confirmed with us that you provided the authorized agent permission to submit the request on your behalf.

For requests to opt-out of personal information “sales” or “sharing,” we may ask you to provide a signed permission demonstrating your authorized agent has been authorized by you to act on your behalf.


  • How We Disclose Information: We disclosed personal information to third parties for business and commercial purposes during the last 12 months. For more information on the categories of information we disclosed and to whom it was disclosed, see the “How We Use or Share Your Personal Information” section above. As further described above in the “Information We Collect” and “Your Rights and Choices” sections above, we also use cookies and other tracking technology on our Site that collect data and that information is disclosed to advertising networks, which may also be considered a sale under California law. We do not collect or sell the personal information of minors under age 16.
  • Third-Party Marketing Disclosure: Under California Civil Code § 1798.83, California residents with whom we have a business relationship can request information about the types of personal information, if any, we shared with third parties for the direct marketing purposes of the third parties and the identities of the third parties with whom we shared such information in the last 12 months. We do not share your personal information with third parties in this manner and have not done so in the last 12 months. You may request more information by contacting us using the contact information at the bottom of this privacy policy.
  • Financial Incentives: In some cases, we may offer you financial incentives as permitted by law in exchange for the collection, retention, or use of certain personal information about you. Each financial incentive related to the collection and use of personal information is based upon our reasonable, good-faith determination of the estimated value of such information to us. When applicable, we will provide information about the specific terms of the financial incentive and your rights on the webpage or form where the financial incentive is made available.
  • Sign-up-and-Save Offers: From time to time on certain websites we may offer a “sign up and save” offer. The offer is a one-time coupon if you provide us your first name and email address and agree to receive e-newsletters and marketing or promotional emails. If and when you sign up, we may also use your name and email address in accordance with the terms of our Privacy Policy. Once you accept the “sign up and save” offer, your coupon code will be provided via email. Offers may not be combined. The “sign up and save” offer may not be available at all times or on all websites. Any other terms of the “sign up and save” offer and the amount of the one-time coupon will be presented to you at the time of the offer.

    You may opt in by providing your first name and email address in response to the “sign up and save” offer. You can withdraw from this financial incentive at any time by selecting the unsubscribe link in the email that you receive or by making a Privacy Rights request by either calling us at 1-888-215-2958 or emailing us at info@lundberg.com (please include “Unsubscribe Request” in the subject line of your message).

    This offer is reasonably related to the value of your personal information that you are providing to us. Our good faith estimate of the value of your personal information is the value of the discount offered to you. We calculated the value of your personal information based on our expenses related to providing the offer.


NOTICE TO RESIDENTS OF COLORADO
This section describes the personal data (as defined by the Colorado Privacy Act, including its implementing regulations, or the “CPA”) we collected about Colorado residents in the last 12 months, the sources of that data, our business or commercial purposes for collecting the data, and the third parties with whom we sold or shared that data. We will need to verify your identity and confirm you are a resident of Colorado before processing most requests, which may require us to request additional personal data from you. In order to verify your identity, we will generally require either the successful authentication of your account, or the matching of information you provide us to the information we maintain about you in our systems.   • Right to Delete: You have the right to request us to delete the personal data we have collected from or about you. You do not need to create an account with us to exercise your Right to Opt-Out of Sale, Targeted Advertising or Profiling. However, we may ask you to provide additional personal data so that we can properly identify you in our dataset to facilitate the opt-out request. We sell personal data and process it for targeted advertising purposes, which means we display advertisements to you based on information we obtain about you through nonaffiliated websites or online applications to predict your interests or preferences.  We sell or share your personal data for the purposes further described in the table in “How We Use or Share Your Personal Information” section of this Privacy Policy. Please see your rights to opt out from these activities listed above.

In certain circumstances, we may decline a request to exercise the rights described above. If your request is denied, we will provide an explanation for the denial and instructions on how you may appeal a denied request. We do not discriminate against you for requesting any of the rights noted above.  We will process your request in accordance with applicable law.

We will only process your Sensitive Data in accordance with applicable law, including obtaining your consent prior to processing. We will not process personal data of consumers we know to be less than 13 years of age unless we receive affirmative authorization from the parent or guardian of a child less than 13 years of age.

NOTICE TO RESIDENTS OF CONNECTICUT
This section describes the personal data (as defined by the Connecticut’s Act Concerning Personal Data Privacy and Online Monitoring or the “CTPA”) we collected about Connecticut residents in the last 12 months, the sources of that data, our business or commercial purposes for collecting the data, and the third parties with whom we sold or shared that data.
